1. Who we are

This website, bostoncone.com (the “Site”), and the Scotland Loves Boston and Boston Cone brands are owned and operated by Made Brave Ltd, a company registered in Scotland (company number SC414313) with its registered office at The Social Hub, 15 Candleriggs Square, Glasgow G1 1TQ, United Kingdom (“we”, “us”, “our”).

By using the Site or placing an order, you agree to these terms. Please read them before you buy — they set out who you're buying from, how orders work, and what your rights are. Nothing in these terms affects your legal rights as a consumer.

2. About Scotland Loves Boston and the charities we support

Scotland Loves Boston began as a celebration of the friendship between Glasgow and Boston, and grew into a fundraising campaign for two mental health charities: SAMH (Scottish Action for Mental Health) in Scotland and MAMH (the Massachusetts Association for Mental Health) in the United States.

The Site is operated on a commercial basis by Made Brave Ltd. It is not a charity and purchases from the Site are not donations. A share of the proceeds or profits from products sold on the Site is paid to SAMH, MAMH and, in some cases, other campaign partners. The share that applies to each product is stated on the relevant product page. For some products, 100% of profits go to charity; for others, a stated percentage does.

If you would like to donate directly, you can do so through the campaign's JustGiving page, which is linked from the Site. Direct donations made through JustGiving go to the charities and are not handled by us.

3. Buying from the Site

Placing an order

When you place an order you are making an offer to buy. We accept your order when we send you an order confirmation email — that is when the contract between us is formed. We may decline or cancel an order where, for example, a product is unavailable, we identify a pricing or description error, or we suspect fraud. If we do, we will let you know and refund any payment taken.

Prices and payment

Prices are shown in pounds sterling (GBP) or US dollars (USD) depending on the region you select, and include VAT where it applies. Delivery charges are shown at checkout before you pay. For deliveries outside the UK, you may need to pay import duties or taxes charged by your local authorities — these are your responsibility and are not included in our prices.

If we discover an obvious pricing error, we are not obliged to sell at the incorrect price and will contact you before proceeding.

Product descriptions

We work hard to show our products accurately, but colours may display differently depending on your screen, and as each item is printed to order there may be minor variations in print placement. This doesn't affect your rights if a product is faulty or not as described.

4. How our products are made and delivered

We operate the storefront. Everything physical — sourcing the garments, printing, quality control, packing, shipping and returns processing — is carried out by our fulfilment partner, Printful, from its production facilities in the UK, Europe or the US depending on your location. We don't hold stock and items are never handled by us: each product is made when you order it, so please allow the production time shown on the Site in addition to delivery time.

Your purchase contract is with Made Brave Ltd as the seller, and Printful fulfils orders on our behalf. Any issue with an order is resolved through Printful's fulfilment process, as set out in section 5 below.

Delivery estimates are estimates only. We are not responsible for delays caused by carriers, customs processing or events outside our reasonable control.

5. Cancellations, returns and refunds

If something is wrong with your order

If an item arrives damaged, defective, misprinted, or the wrong item, or your package never arrives, contact support@bostoncone.com within 30 days of delivery (or the estimated delivery date, for packages that don't arrive) with your order number and a clear photo of the issue. Your claim will be handled through Printful's claims process: verified issues are resolved by Printful directly, normally with a free replacement made and reshipped to you, or a refund. In most cases you won't need to return the faulty item. Where a return is needed, it goes to Printful's fulfilment facility — we will give you the address — not to us.

Please report issues within the 30-day window above so your claim can be processed — late reports may mean a replacement can't be arranged through the fulfilment process, though this does not affect your statutory rights.

If you change your mind

If you are a consumer in the UK or EU, you have a legal right to cancel your order within 14 days of receiving your items, for any reason. To cancel, email support@bostoncone.com within that period, then return the items — unworn, unwashed and in their original condition — to the returns address we give you (Printful's fulfilment facility) within 14 days of telling us. We will refund the price you paid, including standard delivery, within 14 days of the items being received back. Return postage for change-of-mind returns is at your cost. Because items are printed to order, we can't offer size exchanges — cancel and reorder instead.

Your statutory rights

Full details, including how refunds are processed, are set out in our Refund Policy on the Site. Nothing in these terms limits your statutory rights under the Consumer Rights Act 2015 or, if you are outside the UK, the mandatory consumer laws of the country where you live.

6. Photos, videos and other content you share with us

A big part of this campaign is the photos, videos and stories that people share — through the Site's upload link, by email, in the Scotland Loves Boston Facebook group, or by tagging the campaign on social media.

By submitting or sharing content with the campaign, you give us a free, worldwide, ongoing permission to use, edit, reproduce and display that content in connection with Scotland Loves Boston and the Boston Cone — for example on the Site, on social media, in campaign films, exhibitions or other materials celebrating the campaign. You confirm the content is yours to share, that anyone identifiable in it is happy for it to be used, and that it doesn't infringe anyone else's rights.

You keep ownership of your content, and if you change your mind you can ask us to stop using it in future materials by emailing traffic@madebrave.com. We'll act on that request as soon as reasonably practical, though it may not be possible to remove content from materials already published or printed.

7. Our brand and intellectual property

The Boston Cone, Scotland Loves Boston and No Boston No Party names, logos, cone designs, illustrations (including the hand-illustrated cone artwork), photography, and all other content on the Site are owned by, or licensed to, Made Brave Ltd and are protected by trademark, copyright and other intellectual property laws.

You are welcome to share, photograph and celebrate the campaign personally — that's the whole point. But you may not use our names, logos, designs or artwork commercially, including on merchandise, in advertising, or in a way that suggests a partnership or endorsement, without our prior written permission. If you'd like to partner with the campaign, get in touch — we'd love to hear from you.

8. Acceptable use of the Site

You may use the Site for lawful purposes only. In particular, you must not misuse the Site by introducing malicious code, attempting to gain unauthorised access, scraping content or product data at scale, or using the Site to send spam or to harass others. We may suspend or restrict access to the Site where we reasonably believe these terms are being broken.

9. Third-party services and links

The Site links to and embeds services run by others — including JustGiving (donations), the live cone tracker, social media platforms, and our partners' websites. Those services have their own terms and privacy policies, which apply when you use them. We are not responsible for third-party sites or services, though we only link to ones we consider relevant to the campaign.

The Site runs on Shopify, which processes orders and payments on our behalf. Your purchase contract is with Made Brave Ltd, not with Shopify.

10. Our responsibility to you

If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for losses that are not foreseeable, or for business losses — the Site is for personal, consumer use.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under law — including your rights to receive products that are as described, of satisfactory quality and fit for purpose.

Other than the liability described above, our total liability to you in connection with any order is limited to the price you paid for that order.

11. General

     We may update these terms from time to time. The version published on the Site when you place an order is the one that applies to that order.

     If any part of these terms is found to be unenforceable, the rest will continue to apply.

     If we don't enforce a right under these terms straight away, we can still enforce it later.

     We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens and it will not affect your rights.

12. Governing law

These terms are governed by the law of Scotland, and any dispute can be brought in the Scottish courts. If you live elsewhere in the UK you may also bring a claim in your local courts, and if you are a consumer outside the UK, you keep the benefit of any mandatory consumer protections of the country where you live.
